We practice alternative dispute resolution more commonly in the form
of mediation. It is an informal process in which a neutral person facilitates
communication between disputants to assist them in reaching a mutually
acceptable agreement, without any legal proceedings. The Courts encourage
mediation as a form of a more economic means of resolving disputes,
as opposed to more contentious and costly litigation which is often
time consuming. Both the Supreme Court and the Subordinate Courts would
refer cases to mediation before proceeding with Trials, where appropriate,
to consider the possibility of settlement of the dispute.
